Introduction

Welcome to Klam, the video‑first dating app designed to help you make real, meaningful connections. By accessing or using Klam’s mobile application, website, or any related services (the “Services”), you agree to be bound by these Terms, our Privacy Policy, and our Cookies Policy. If you do not agree, please do not use the Services.

Important Subscription Notice:
If you purchase a subscription, it will automatically renew for additional periods of the same duration as the initial term you selected, at the then‑current price (plus applicable taxes), unless you cancel before the renewal date. You can manage or cancel your subscription through your device’s account settings (Apple App Store or Google Play) or in‑app where available. For purchases via Apple, refunds must be requested from Apple.

Eligibility

To use Klam, you must:

  • Be at least 18 years old (or the age of majority in your jurisdiction if higher).
  • Have the legal capacity to enter into a binding agreement with Klam.
  • Not be prohibited by law from using our Services.
  • Not have been previously removed or banned from Klam or a similar platform for violating terms or engaging in harmful behavior.

By creating an account, you represent and warrant that you meet these requirements. We may refuse access or terminate accounts if we believe you do not meet these criteria.

Your Account

When you create an account, you agree to:

  • Provide accurate, truthful information and keep it current.
  • Keep your login credentials confidential and not share them.
  • Accept responsibility for all activity under your account.

You may not:

  • Create more than one account for yourself.
  • Create an account on behalf of someone else or use another person’s account without permission.
  • Transfer or sell your account.

If you suspect unauthorized access or a security breach, contact [email protected] immediately. Klam is not liable for losses caused by unauthorized use if you fail to safeguard your credentials.

Klam’s Video‑First Features

  • Matching & Scheduling: When a match occurs (mutual like), either party can propose a date & time for a video call.
  • In‑call Prompts: We may surface conversation starters; premium users may pre‑submit prompts that appear at random during the call.
  • Phone number exchange: Numbers are exchanged only after mutual consent via an in‑app flow.
  • No default recording: Klam does not record video calls by default. If we ever pilot optional recording for safety related to a reported incident, we’ll request consent, show clear notices, and limit retention per our Privacy Policy.

Coaching Marketplace (Optional)

Users who opt in as Dating Coaches may offer paid services (e.g., profile reviews, conversation coaching).

  • Independent Providers: Coaches are independent contractors, not employees or agents of Klam. They are responsible for their content, compliance with laws, and all taxes on earnings.
  • Bookings & Payments: Processed by third‑party payment providers. Klam may charge service fees to Coaches and/or Members; fees are disclosed at checkout.
  • Ratings & Reviews: Members may leave reviews. Klam may moderate but does not endorse user statements.
  • No professional advice: Coaching content is informational only—not medical, legal, psychological, or financial advice.
  • Disputes & refunds: Raise coaching disputes via in‑app support. Resolution follows our then‑current Marketplace Policies.

Subscriptions, In‑App Purchases & Auto‑Renewal

General Terms

  • Your subscription auto‑renews for the same term at the then‑current price (plus taxes) unless you cancel before renewal.
  • You can manage/cancel your subscription via Apple App Store or Google Play account settings, or in‑app where available.
  • For Apple purchases, refund requests must be made through Apple.

Pricing

  • Prices may vary based on your region and applicable taxes.
  • Subscription length may affect pricing.
  • Promotional rates and discounts may be available at the time of purchase.
  • Currency and exchange rates can influence pricing.

We may change pricing for future renewals. Any price change will not affect your current term.

Refunds

Generally, all purchases are final and non‑refundable, and there are no refunds or credits for partially used periods, except where required by law in your jurisdiction.

  • EU, EEA, UK, and Switzerland: You are entitled to a full refund within 14 days after your subscription begins, in line with local law. The 14‑day period starts when the subscription begins.
  • Other regions: Refund rights vary by local law. If applicable, request a refund by contacting [email protected].
  • If you subscribed via Apple or Google Play, refund requests must be made through those platforms.

Installment Plans

  • If we offer an installment plan and you select it, you agree to pay the full subscription price in the specified number of installments.
  • By selecting the plan and clicking “Subscribe,” you authorize us (or our processor) to charge each installment to your payment method on scheduled dates.
  • If an installment fails, we may suspend or terminate access to premium features until payment is completed.

Safety, Reporting Abuse & Enforcement (Including Suspension)

Your safety is our priority. We provide tools like report and block to help you manage interactions. If you experience or witness harmful behavior, report it via the app or email [email protected]. For emergencies, contact local authorities.

Prohibited behavior includes:

  • Harassment, threats, impersonation, or hate speech.
  • Sharing or soliciting illegal content.
  • Recording or distributing others’ video calls without clear consent.
  • Scams, spam, or unauthorized commercial activity.
  • Uploading content that infringes intellectual property or privacy rights.

Consequences:

  • We may suspend your account temporarily while investigating reports of abuse or violations.
  • Suspension may restrict access to features or the entire app.
  • Repeated or severe violations can lead to permanent termination (see Termination of Your Account).

Termination of Your Account

You may delete your account at any time in Settings. Deleting your account does not automatically cancel your subscription—you must manage cancellations through your Apple App Store or Google Play account settings.

We may terminate your account without notice if:

  • You violate these Terms or our policies.
  • You engage in harmful, fraudulent, or illegal activity.
  • We are required by law or regulatory authorities.

Upon termination:

  • Your profile and content may be removed from the Services (subject to retention obligations in our Privacy Policy).
  • Certain provisions survive termination (e.g., licenses, disclaimers, limitation of liability, dispute resolution).

Your Content; Our License

You retain ownership of your content. By posting or making content available on Klam (photos, bios, prompts, reviews), you grant Klam a non‑exclusive, worldwide, royalty‑free license to host, store, reproduce, adapt, publish, and display such content as necessary to operate, improve, and promote the Services.

Third‑Party Services & SDKs

The Services may integrate third‑party SDKs (e.g., analytics, payments, communications). Your use of those features may be subject to third‑party terms and privacy policies. See our Privacy Policy and Cookies Policy for details.

App Stores & Third‑Party Terms

If you download or access Klam through a third‑party platform such as the Apple App Store or Google Play, you acknowledge that:

  • Additional Terms Apply: Your use of Klam is also subject to the terms and conditions of the app store provider. These platforms may impose their own rules regarding payment processing, subscription management, and refunds.
  • Subscription Management: If you purchased a subscription through an app store, you must manage or cancel it directly through that platform. Klam cannot process cancellations or refunds for purchases made via Apple or Google Play.
  • Refund Requests: For Apple purchases, all refund requests must be submitted to Apple, as Apple controls billing for those transactions. For Google Play purchases, follow Google’s refund process.
  • Third‑Party Rights: The app store provider is not responsible for providing Klam’s Services or for addressing any claims related to the Services, including product liability, legal compliance, or intellectual property infringement.
  • License Grant: Subject to these Terms and the app store’s terms, Klam grants you a limited, non‑exclusive, non‑transferable, revocable license to download and use the app on devices you own or control, solely for personal, non‑commercial purposes.
  • No Endorsement: The app store provider is not a party to these Terms and does not endorse or assume responsibility for Klam.

Disclaimers & Limitation of Liability

Klam provides the Services on an “AS IS” and “AS AVAILABLE” basis. We do not guarantee any particular outcomes, matches, or dates, nor uninterrupted or error‑free operation. To the fullest extent permitted by law, we disclaim all warranties (express or implied).

To the maximum extent permitted by law, Klam and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amounts you paid to Klam in the 12 months preceding the claim (or £100 if greater).

Dispute Resolution; Governing Law

If you reside in the United States: Except for small claims and certain claims excluded by law, disputes will be resolved by binding arbitration on an individual basis (with an opt‑out right). Additional procedures and rules will be provided in Klam’s US Arbitration Addendum.

If you reside outside the United States: These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, unless mandatory consumer law in your country provides otherwise.

International Transfers

Klam may process and store data in countries outside your residence, including the United Kingdom and India. We use safeguards like Standard Contractual Clauses and the UK Addendum where applicable. See our Privacy Policy for details.

Privacy & Cookies

Your use of the Services is also governed by our Privacy Policy and Cookies Policy, which explain what we collect, how we use it, cross‑border transfers, retention, your rights, and how to manage cookies/SDKs.

Changes to These Terms

We may update these Terms to reflect changes to our Services or legal requirements. If we make material changes, we will notify you via the app, email, or other reasonable means and update the Effective date above. Your continued use after the effective date constitutes acceptance.
